Copyright Infringement Verdict
We won a jury verdict of willful copyright infringement and violation of Section 512(f) of the DMCA on behalf of the creators of a children’s entertainment juggernaut program, with the jury awarding damages totaling $23.4m and the Court entering a broad permanent injunction.
Dismissal with Prejudice
We obtained a dismissal with prejudice at the pleading stage, of all claims asserted against defendant, a leading game developer, in a putative class action challenging the legality of video game loot boxes under California’s unfair competition laws. On appeal, the Ninth Circuit concluded that the Plaintiff lacked standing in the first instance.
Injunction & Public Apology
We represented a leading cybersecurity company in the District of Delaware asserting claims against testing house for reporting false and misleading test results; violating the Computer Fraud and Abuse Act; and trade secret misappropriation. The case resulted in a settlement consisting of a stipulated injunction and a public apology. We simultaneously defended our client in a countersuit brought in the Northern District of California by the counterparty asserting antitrust violations, winning a complete dismissal with prejudice of those claims.
Compelled Arbitration
We successfully enforced Defendant video game developer’s arbitration clause and class action waiver in a putative class action targeting a most popular mobile game, winning a motion to compel arbitration which effectively ended the dispute.
Invalidated Patent
We represented Defendant in invalidating a patent under 35 U.S.C. Section 101 at the pleadings phase and successfully defended that win on appeal to the Federal Circuit.
Defended Copyright Ownership
We obtained a favorable settlement for our client, developer of a cult favorite video game, in a complex dispute over the game’s ownership, paving the way for the continued success of the game.
Defense Trade Secret Verdict
We represented the co-founder of a semiconductor solutions provider in a case brought by his former employer alleging trade secret misappropriation and breach of contract. The jury found in favor of our client, exonerating him of wrongdoing.
