Udit Sood

Udit has litigated complex commercial disputes for over a decade and in two continents. With a background in CS/C++, Udit focuses on patent and trade secret cases involving AI/robotics, semiconductors, software, communication and video compression standards, data storage/security, and gaming.  He litigated IP cases at Covington & Burling LLP (based out of its San Francisco office) for 9 years prior to joining Tyz Law Group.

Udit has experience with all phases of complex commercial litigation.  He played key roles, like examining witnesses, and arguing jury instructions and post-trial motions, in an Eastern District of Texas jury trial, a Northern District of California bench trial, and arbitration.  Udit has extensive experience leading written, document, and deposition discovery.

In 2015, Udit earned an LLM in Law, Science & Technology from Stanford Law School. While at Stanford, Udit coached a team competing at the prestigious Jessup International Law Moot Court Competition, which qualified to the world championship for the first time in the law school’s history.

Between 2011 and 2014, Udit litigated high-value IP cases before the Delhi High Court and the Supreme Court of India.  He graduated in 2011 from the National University of Juridical Sciences (Kolkata, India) with a gold medal in Patent Law for standing 1st in order of merit among 100+ students.  He graduated in 2006 from St. Columba’s School (New Delhi, India) with a gold medal in CS/C++ for standing 1st in order of merit among 50+ students.

Udit is a lead petitioner for marriage equality before the Supreme Court of India.  He previously represented transgender employees in a sex discrimination lawsuit against the State of Tennessee.  He sings with the San Francisco Gay Men’s Chorus and is on the non-profit’s board of directors.  In 2022, Udit co-founded a startup developing cutting-edge AI tools for eDiscovery / investigations; he served as the startup’s Product Advisor until 2024, helping scale the company from zero to $20M+ valuation.

In his free time, Udit enjoys skiing, traveling, playing video games, and reading fiction by the pool.

REPRESENTATIVE MATTERS*:

  • Delivered complete pre-trial victory in a ten-patent case in the Eastern District of Texas accusing essentially all of the semiconductor client’s business.  Lead tech-focused associate for three patents relating to CMP, SiGe deposition, and manufacturing consumables; lead damages associate across the case.

  • Secured asking royalty rate and over $30 million in patent damages from Eastern District of Texas jury for infringement of satellite communication patents.  As lead damages associate, formulated damages theories, led discovery on damages issues, first and second chaired depositions, second chaired witness examinations at trial, argued jury instructions.

  • Prosecuted patent infringement claims against a major internet service provider.  Formulated infringement and non-infringement theories for patents relating to network security, data storage, and MoCA 2.0 standard.  Successfully argued motion to dismiss counterclaims before Judge Alsup in the Northern District of California.

  • Prosecuted a contentious false advertising case in the Northern District of California over SeaWorld’s captive orcas.  Led discovery; argued case dispositive, discovery, and evidentiary motions; argued pre-trial motions; first chaired witness examinations at bench trial; successfully opposed the defendant’s JMOL following case-in-chief.

  • Favorably resolved infringement claims against client’s flip-chip, system-on-chip (SoC), memory (DRAM), and other products.  Lead associate for two patents; drafted complaint for declaratory judgment and IPR petitions.

  • Delivered completed defense victory for a global consumer medicines client in $1.8 billion arbitration for trade secret misappropriation and breach of contract claims concerning ultra-rapid insulins. Lead tech associate; drafted four expert reports; second chaired fact and witness examinations.

  • Challenged a $172 million jury verdict in Eastern District of Texas case asserting patents for simulation of TCP/IP and other wireless connections.  Drafted JMOL and ex parte review petitions, and negotiated favorable resolution.

  • Defended and favorably resolved patent infringement claims brought before the International Trade Commission relating to AVC/H.264/MPEG 4-10 and HEVC/H.265/MPEG-H 2 standards. Led development and discovery of equitable defenses.

  • Defended claims in the District of Nevada of infringement of patents directed to slot machine games. Prepared IPR petition challenging adversary’s design patent and helped obtain favorable settlement.

  • For Indian OEMs, defended cellphone manufacturers in SEP disputes (GSM / 2G / 3G patents) before the Delhi High Court and the Competition Commission of India.  Successfully initiated what is recognized as the first antitrust investigation in India for SEP misuse.
